The petitioner has renewed his prayer for bail in a case registered under section 307 and other sections of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 8.12.2021 (Annexure-1) passed in Cr. Misc. no. 18662 of 2021 giving liberty to the petitioner to renew his prayer for bail after six months. The petitioner is in custody since 14.9.2020.

Having heard learned counsel for the parties and

No.41816 of 2022(2) dt.14-09-2022 2/2 taking into consideration the facts of the case together with the petitioner having remained in custody since 14.9.2020, the liberty granted by the earlier order of rejection dated 8.12.2021 and eight months having passed since passing of the said order, the petitioner is directed to be enlarged on bail in connection with Chandauti P.S. Case no. 123 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
