JUSTICE PURNENDU SINGH ORAL ORDER 19-01-2022 Heard the parties through video conferencing. Learned counsel for the petitioner seeks permission to withdraw the present bail application in view of the fact that the Pairvikar of the case has played fraud upon this Court by furnishing forged medical prescription of Government Medical College and Hospital, Purnea, which is confirmed by the report dated 13.01.2022 and the documents annexed with it. Learned Senior Counsel Sri Anjani Kumar, assisted by Ms. Archana Palkar Khopde, Advocate, has submitted that considering the fact that Sri Purushottam Kumar Jha has fairly submitted that the Pairvikar has given him false information

Patna High Court CR. MISC. No.52162 of 2021(7) dt.19-01-2022 2/2 and when he came to know about the same he has sought permission to withdraw the present bail application and in that view of the matter appropriate legal action be taken against all the concern person, who have played fraud upon the Court. In view of the above, the present application filed on behalf of petitioner is dismissed as withdrawn. Accordingly, the office is directed to place the record of this case along with all the reports submitted by the Superintendent, Government Hospital, Purnea as well as the prescription, which has been found to be forged on which basis mentioning for early hearing of the case was made before the Registrar General.

The Registrar General, Patna High Court, Patna is directed to hold inquiry against all the concerned persons and if prima facie it appears that they have committed fraud upon the Court deliberately and knowingly by giving false information to this Court, he is directed to file criminal complaint against all the accused persons against whom the allegation is found to be true before the competent Court having jurisdiction and report this Court accordingly.
