The petitioner is accused in connection with Sikarpur P.S. Case No. 25 of 2015 registered under sections 20, 22, 23 of the N.D.P.S. Act pending in the Court of Addl. Dist. And Sessions Judge-5th, Bettiah, West Champaran.

The accusation is of recovery of one country-made loaded pistol and Charas.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case with ulterior motive. Petitioner is in custody since 21.09.2015.

Learned A.P.P. opposed the prayer of the petitioner

Patna High Court Cr.Misc. No.48951 of 2016 (3) dt.02-02-2017 2/2 with submission that the petitioner has criminal antecedent and he has also involved in so many cases.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
