The petitioner seeks bail in Mahua Police Station (for brevity, PS) Case No 207 of 2019 instituted for the offence punishable under Sections 395, 397, 412.
20 persons have allegedly broken the house of the informant and indulged in loot.
It is submitted by petitioner's counsel that co-accused Md Zafar Quraishi was apprehended from whose possession, a looted mobile phone was recovered leading to his implication in this case. The said Md Zafar Quraishi has been allowed bail by this Court and the other co-accused persons have also been allowed bail by this Court in Cr Misc No 20022 of 2020, Cr
Patna High Court CR. MISC. No.37895 of 2020(2) dt.08-02-2021 2/3 Misc No 13575 of 2020, Cr Misc No 74438 of 2019, Cr Misc No 58612 of 2019 and Cr Misc No 63687 of 2019 (Annexure 2 series. Petitioner's name transpired in the confessional statement of co-accused Md Zafar Quraishi. The petitioner has criminal antecedents but he is on bail in both the cases, as per disclosure made in paragraph 3 of the instant petition. He is now in custody since 27.01.2020.
Learned APP has opposed the prayer for bail.
Considering the rival submissions, prayer for bail is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Mahua PS Case No 207 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
