2. The petitioner seeks bail in connection with Simri P.S.Case No. 240 of 2023 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

3. The prayer for bail of the petitioner was rejected vide order dated 22.02.2024 passed in Cr. Misc. No. 10527 of 2024.

4. It has been submitted by the learned counsel for the petitioner that in trial, the informant is uncle of the deceased and the mother of the deceased have not supported the prosecution case.

5. Considering the facts that the witnesses are not

Patna High Court CR. MISC. No.46255 of 2024(2) dt.26-07-2024 2/2 supporting the prosecution case, during the trial and also considering the fact that petitioner is in jail since 16.07.2023, this application is allowed, let the above named, petitioner is directed to released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Buxar in Simri P.S.Case No. 240 of 2023.

6. After release, the petitioner will co-operate in the trial.
