The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B, 498A and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant within four years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that the victim committed suicide for which UD Case No. 7 of 2012 in Bhagwanpur police station was registered at the behest of the petitioner.

Considering the thrust of accusation against this

Patna High Court Cr.Misc. No.40231 of 2015 (2) dt.28-08-2015 2/2 petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, it is rejected.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhagwanpur P.S. Case No.68 of 2012, pending before the learned Chief Judicial Magistrate, Vaishali at Hajpur.
