This application is for grant of regular bail in connection with Chhatauni P.S.Case No.106 of 2017, registered for the offences punishable under Sections 420, 379 and 411/34 of the Indian Penal Code.
Allegation against the petitioner and the other coaccused persons is of withdrawing Rs.20,000/- from the A.T.M. by changing the ATM Card of the informant. It further appears that one co-accused has been arrested on the spot whereas the other co-accused person fled away.
Submission of the learned counsel for the petitioner is that A.T.M. Car and money have not been recovered from the
Patna High Court Cr.Misc. No.33315 of 2017 (3) dt.08-08-2017 2/2 possession of the petitioner and he is in custody for three months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of charge in this case.
With the aforesaid observation, this application is dismissed.
