====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Hathauri P.S. Case No. 72/2020 registered for the offences punishable under Sections 341, 323, 386, 387, 504 and 506/34 of the Indian Penal Code 1860.

The informant is a driver and while he was driving his truck, four persons including the petitioner stopped his truck and demanded extortion and in the meanwhile, coaccused Utsav Kumar snatched Rs.40,000/- from the pocket of the informant and when the informant protested, the petitioner pointed pistol on his head.

No.51621 of 2021(2) dt.15-04-2022 2/3 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case along with other accused persons. He further submits that from perusal of the First Information Report, it would be evident that money was snatched by co-accused Utsav Kumar and only allegation against the petitioner is that he pointed pistol on the informant but the present case has not been registered under the Arms Act. He next submits that the petitioner is in custody since 8.4.2021 and co-accused Manish Pandey has been granted bail by this Court in Cr. Misc. 2435 of 2021. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioner is in custody since 8.4.2021 and the money was snatched by the co-accused, charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, learned Judicial Magistrate, 1st Class, Muzaffarpur, in
