Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Rakesh Narayan Singh For the Opposite Party/s : Mr. M.K.Nirala, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-02-2016 Heard Mr. Pandey, counsel for the petitioner and Mr. M.K. Nirala, APP for the State.
Although the petitioner is named in the first information report registered under Sections 302, 201, 120B of the Indian Penal Code but it is stated that only a suspicion has been raised as the petitioner allegedly had come to the house the previous evening. The contention is that the petitioner is juvenile in conflict with law. His date of birth recorded in the school register is 10.02.2001. The father of the petitioner, who is also cited as an accused of the present, has since been released on regular bail. Having heard the parties, in my view, if the petitioner is juvenile, he must appear before the Juvenile Justice Board of the District and seek the protection of the Juvenile Justice (Care and Protection of Children) Act, 2000. The application stands disposed of.
