Petitioner seeks bail in connection with K. Hat P.S. Case No. 681 of 2017 arising out of S.T. No. 117 of 2018 & CIS No. 117 of 2018 registered for the offence punishable under Sections 363/366A/34 of the Indian Penal Code. Allegation against the petitioner is of abducting the daughter of the Informant.

It has been submitted on behalf of the petitioner that there is delay of one month in lodging the FIR. It has been submitted on behalf of the petitioner that there was love affair between the petitioner and the daughter of the Informant and daughter of the Informant on her own volition has married

Patna High Court Cr.Misc. No.40122 of 2018(3) dt.18-09-2018 2/2 petitioner. It has been further submitted that the victim girl in her statement under Section 164 of the Cr.P.C has herself stated her age to be of 20 years. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 26.04.2018 in Criminal Miscellaneous No. 13474 of 2018. Petitioner has got no criminal antecedent and is in custody since 16.12.2017.

Learned counsel for the Informant vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge-1st, Purnea, in connection with K. Hat P.S. Case No. 681 of 2017 arising out of S.T. No. 117 of 2018 & CIS No. 117 of 2018. (S. Kumar, J) ranjan/- U
