The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
It is alleged that three culprits came and on the point of pistol, snatched Rs.80, 000/- from the informant and took away his purse containing driving licence, smart card and Rs. 2000/-. Thereafter the accused persons fled away on two motorcycles. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with an observation "at this stage". This is the second attempt for bail on behalf of the petitioner.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.33233 of 2017 (3) dt.01-11-2017 2/2 petitioner is in custody since 18.03.2016. Charge sheet has been submitted. There is no allegation of tampering of witnesses against the petitioner. The other co-accused have been granted bail. The petitioner is not named in the F.I.R. His name has come on the basis of his confessional statement made in Barachatty P.S. Case No. 80 of 2016. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it has been submitted that the petitioner is said to have been identified in course of T.I.P. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachatty P.S. Case No. 76 of 2016.
