JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner. Despite repeated calls, no body appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with Chandauti (Chakand) P.S.Case No. 92 of 2016 registered under Section 414 of the Indian Penal Code.
It is contended by the learned counsel for the petitioner that the alleged vehicle i.e. Pick-Up Van carrying coal was being driven by the co-accused Neeraj Kumar. It is further contended that the petitioner being owner of the said vehicle has no concern with the alleged recovery of coal. It is also contended that the petitioner having roots in the society has got no criminal antecedent and is not likely to flee from justice. Considering the nature of allegation and the submissions made above, the petitioner named above is directed to
Patna High Court Cr.Misc. No.22309 of 2017 (3) dt.07-07-2017 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S.Case No. 92 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of his arrest or surrender before the court below within six weeks from today.
