Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Maigra P.S. Case No. 14 of 2019 (G.R. No. 364 of 2019), registered under Sections 147, 148, 149 and 302 of the Indian Penal Code, pending in the Court of Sri G.N. Dubey, Judicial Magistrate, 1st Class, Sherghati, Gaya.

The prayer of bail of the petitioner has already been refused on merit vide Cr. Misc. No. 74077 of 2019 on 17.03.2020.

Submission is that the petitioner and the informant are

Patna High Court CR. MISC. No.6733 of 2021(2) dt.17-02-2021 2/2 gotia and occurrence took place due to land dispute and the petitioner is in custody since 28.03.2019.

Taking into consideration the nature of allegation as made against the petitioner to give spade blow at the head of the deceased, Sushila Devi, wife of the informant, I am not inclined to re-consider the prayer for bail to the petitioner. The prayer for bail is rejected.
