JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, the informant suspected the involvement of the petitioner in the present crime. Subsequently, petitioner was arrested and two mobile chips were recovered from his conscious possession. Petitioner confessed his guilt leading to recovery of some mobile sets from his house but there is nothing on the record to show that stolen article of the present case was recovered either from possession of the petitioner or from his

No doubt, petitioner does have criminal antecedent of near about ten cases of similar nature but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro P.S. Case No. 218 of 2016.
