The petitioner seeks bail in Jogbani P.S. Case No. 19 of 2018 registered for the offence punishable under Sections 25(1-b)a, 26/35 of the Arms Act.

Allegation against the petitioner is of recovery of 2 country made pistols and other articles.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that the petitioner was not present in his house when the raid was conducted and as the petitioner has got criminal antecedent, he has been implicated in this case. Petitioner is in custody since 27.02.2018.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.39892 of 2018(3) dt.23-08-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jogbani P.S. Case No. 19 of 2018.
