2. The petitioner seeks bail in connection with Mahila P.S. Case No. 49 of 2024 / POCSO Case No. 140 of 2024 registered for the offence under Section 376, 504, 506 of the Indian Penal Code, under Section 6 of the POCSO Act and under Section 67(A), 66(E) of the I.T. Act.

3. As per the prosecution case, the petitioner is accused of raping the victim girl.

4. The petitioner is in custody since 10.12.2024.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in

6. Learned counsel for the State and Informant have opposed the application of the petitioner for grant of bail.

7. From the statement of the victim girl, it appears that the victim girl and the petitioner were known to each other since last 3 years and it appears to be a case of consensual sex between two consenting adults.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Spl. Court of POCSO-cum-District and Additional Sessions Judge-VI, Bhagalpur/concerned Court below in connection with Mahila P.S. Case No. 49 of 2024 / POCSO Case No. 140 of 2024.
