This is the 4th attempt of the petitioner to seek bail in Simri P.S. Case No. 128 of 2011 registered under sections 302 IPC. Three earlier orders passed by this Court in his case are at Annexure-1 series.
It is submitted that although the trial has been taken up but since June, 2016 no witness has been produced by the prosecution. The petitioner is languishing in jail custody since 21.05.2012. On going through the impugned order, it appears that the trial of the case has been taken up inasmuch as five witnesses have been produced on behalf of the prosecution.
Patna High Court Cr.Misc. No.47741 of 2016 (2) dt.09-11-2016 2/2 Considering the allegation and the previous orders passed against the petitioner, I am not persuaded to extend him the privilege of bail. His prayer is rejected.
