NILU AGRAWAL ORAL ORDER 18-09-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is in judicial custody since 26.06.2017 in connection with Bakhtiyarpur Rail P.S. Case No. 126/2017, for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

The prosecution case as lodged by the informant is that while she was boarding a train there was a big crowd, the petitioner tried to take Rs. 1.5 lakh from her bag and was caught red handed.

It has been submitted by the learned counsel for the petitioner that she is innocent, bears no criminal history and on

Patna High Court Cr.Misc. No.42737 of 2017 (2) dt.18-09-2017 2/2 search, it was found that she was carrying Rs. 14,800/- which was her own money which she was taken along with her for her treatment. He further submits that the petitioner is in advanced stage of pregnancy and has two minor children, hence a sympathetic consideration be given.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and materials on record, le the petitioner named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway Patna in connection with Bakhtiyarpur Rail P.S. Case No. 126/2017, subject to the condition that one of the bailors would be a close relative of the petitioner and if the petitioner is found to have indulged in similar offence in future, the prosecution will be at liberty to move the learned court below for cancellation of her bail bonds.
