The petitioner is in custody in connection with Bhabhua P.S. Case No. 262 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.05.2019. He further submits that in the instant case total 8.64 litres of liquor was seized. He further submits that in the past there is no case against the petitioner under the Excise Act.

Considering the fact that the petitioner was not earlier made accused under the provisions of Excise Act, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two
