JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-07-2017 The petitioner seeks regular bail in connection with Jalalgarh P.S. Case No. 52 of 2014, registered for offences punishable under Sections 366(A), 372/34 and 376 Indian Penal Code and Section 6 of the POCSO Act.
Allegation against the petitioner is of kidnapping the minor girl of the informant and committing rape upon her and further allegation is of selling her for money. It has been submitted on behalf of the petitioner that it is the case of mistaken identity as petitioner is not the person, who was involved in the alleged offence and the police without considering this fact has submitted chargesheet against the petitioner. Further petitioner has been in judicial custody since 05.11.2016.
Patna High Court Cr.Misc. No.18577 of 2017 (4) dt.07-07-2017 2/2 Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and the serious nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible.
