2. None appears for the petitioner.
3. In the instant petition, petitioner has prayed for the following relief/reliefs:
"That the 77 years old petitioner prays to this Hon'ble Court to direct the Respondent No. 02 to 09 in particular to grant the FIRST AND SECOND ACPs i.e. due, and also the REFIX the amounts of the entire retiral benefits in the light of the PAY SCALES 5000-150-8000 (for first
Patna High Court CWJC No.15838 of 2021 dt.04-01-2022 2/2 ACP) i.e. 200-10500 (for second ACP) i.e. all due despite several approaches (oral and written) to the Respondents and also a direction for the payment difference amount in view of the claimed re-fixation of retiral benefits. Due to the nonpayment of the above mentioned claims, the petitioner has got aggrieved, and sought the WRIT JURISDICTION OF THIS COURT for the redressal of his grievance against the Respondents."
4. Short question for consideration in the present petition is whether petitioner is entitled to 1st and 2nd ACP or not? In this regard petitioner stated to have submitted a representation and it is pending consideration on the file of the concerned respondent.
5. The concerned respondent is hereby directed to take note of petitioner's representation and its contents and pass a speaking order as to whether petitioner is entitled to 1st and 2nd ACP and consequential benefits or not? Such a speaking order shall be communicated to the petitioner within a period of three months from the date of receipt of this order.
6. With the above observation, writ petition stands disposed off.
