Petitioner prays for bail in connection with Jhajha P.S.Case No. 72 of 2018 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that the girl is still traceless and for that he has given information about the same to the social media (Annexure-2). Further submission is that material collected during course of investigation shows that there was love affair between the girl and the petitioner and due to that he has been implicated in this case and petitioner is in custody for seven months.

Patna High Court Cr.Misc. No.41022 of 2018 (5) dt.25-09-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that the girl is still traceless. Learned counsel for the informant has drawn my attention towards paragraphs 9, 21 and 22 of the case diary and from perusal of which it appears that the girl was going along with the boy and the boy was apprehended at the Railway Station and from there the girl is traceless.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S.Case No. 72 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate with the Investigating Officer in tracing the girl.
