2. The petitioner seeks regular bail in the present case registered for the offence under Section 379 of the Indian Penal Code.

3. As per the prosecution case, petitioner was caught driving a stolen motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 04.04.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and

Patna High Court CR. MISC. No.45700 of 2024(2) dt.03-07-2024 2/2 circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge if the charge has not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad/concerned Court below in connection with Aurangabad Town P.S. Case No. 131 of 2024 subject to condition that:- (i). The petitioner will mark his attendance at the Risiyap Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
