Petitioner is languishing in judicial custody since 22.04.2018 in connection with Andar P.S. Case No. 70/2018 for offences punishable under Sections 379/411 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while she had gone to visit Majar, someone snatched her gold chain worth Rs. 35,000/-. On alarm the police arrested the petitioner and a piece of chain was found from the possession of the petitioner.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated in the aforesaid case. He further submits
Patna High Court Cr.Misc. No.39384 of 2018(3) dt.07-09-2018 2/2 that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IX, Siwan, in connection with Andar P.S. Case No. 70/2018.
