====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioners. The petitioners seek regular bail in connection with Dhaka P.S. Case No. 180 of 2017 registered for the offence punishable under Sections 420, 414 and 34 of the Indian Penal Code.
The petitioners are said to have been apprehended by the informant i.e. the police personnel and 54 kg silver articles were recovered from their possession.
The learned counsel for the petitioners submits that the petitioners are said to have produced papers for the said ornaments. It is also submitted that the petitioners have clean antecedent, admittedly in the F.I.R. itself it has been mentioned
Patna High Court Cr.Misc. No.33593 of 2017 (2) dt.20-07-2017 2/2 that the petitioners have produced receipt of purchase of the said ornaments. However, there were some differences in the quantity recovered and the receipt produced and the petitioners are in custody since 3.6.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.
Accordingly, the petitioners, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Champaran, Motihari in connection with Dhaka P.S. Case No. 180 of 2017 dated 2.6.2017.
