Petitioner seeks bail in Town P.S. Case No. 48 of 2018 registered for the offence punishable under Sections 457, 380, 401 and 427 of the Indian Penal Code.

Allegation against the petitioner is of cutting away the ATM Machine, though in the FIR he is not named but during investigation involvement of petitioner has been found. Petitioner has also confessed his participation in crime before the police.

It has been submitted on behalf of the petitioner that FIR is against unknown. The name of the petitioner has surfaced in this case on the basis of information given by Spy to the I.O. Petitioner is in custody since 19.03.2018.

No.40292 of 2018(3) dt.18-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Town P.S. Case No. 48 of 2018.
