2. Heard learned counsel for the petitioner and learned A.P.P for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with Belaganj P.S. Case No. 113 of 2023 dated 23.02.2023 registered for the offences u/ss 147, 148, 149, 341, 342, 323, 307, 325 of the Indian Penal Code and sections 25(1-b)a and 35 of the Arms Act and sections 3 and 4 of the Indian Explosive Substances Act and later on added section 302 of the IPC.

4. As per the prosecution case, the petitioner and the

Patna High Court CR. MISC. No.43080 of 2023(2) dt.20-07-2023 2/3 co-accused persons are alleged to have severely beaten three persons who entered their village in a Scorpio with intention to theft. It is further alleged that three live cartridges, one sutli bomb, three mobile phones, and one knife were recovered from the Scorpio vehicle.

5. Learned counsel for the petitioner has submitted that the petitioners is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is no eyewitness in this case. There is no specific allegation against the petitioner. Similarly situated coaccused has already been granted bail by the co-ordinate bench of this court vide order dated 07.07.2023 passed in Cr. Misc. No. 34756 of 2023. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.03.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned
