====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 354 (B), 379 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he tried to outrage modesty of informant. On hearing loud cry, while her husband came to rescue her, then petitioner along with others assaulted them and snatched Rs.700/- from the pocket of informant's husband.
It has been submitted on behalf of the petitioner that he has no criminal antecedent. Both parties are members of same family. Petitioner is Dewar of informant and has been dragged in due to a land dispute. Eviction Suit no. 226 of 2014 has also been filed by Rohit Raj, son of the petitioner, against the husband of the present informant. For the aforesaid reason, this malafide prosecution has been brought against petitioner. On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Kazi Mohammadpur P.S. Case no. 353 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
