This is a case registered under Sections 399, 402 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act. FIR has been lodged alleging that some persons had assembled for committing a robbery and after organizing verification the informant went to the spot from where the instant petitioners were arrested. From the possession of petitioner Ram Lakhan Paswan nothing has been recovered whereas a mobile set was recovered from the possession of petitioner Badri Das. Counsel for the petitioner submits that the petitioners

Patna High Court Cr.Misc. No.33513 of 2017 (2) dt.20-07-2017 2/2 have no criminal antecedent and they are labourers and have falsely been implicated in the present case.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati, Gaya in Sherghati P.S. Case No. 151 of 2017.
