NILU AGRAWAL ORAL ORDER 23-09-2015 Heard Sri. Shubhesh Pandey, learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Begusarai Town (Ratanpur) P.S. Case No. 690 of 2014 registered for the offences punishable under Sections 341, 323, 504, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case as alleged in the F.I.R. is that on 06.11.2014 the informant was going from his house and while he reached near gaddi (stock point), petitioner along with other two accused persons stopped his motorcycle and they asked him as to why he is trying to be a police spy and they assaulted him by butt of pistol resulting injury over his left leg and right hand and on objection, they fired upon him with intention to take his life but

Patna High Court Cr.Misc. No.38955 of 2015 (2) dt.23-09-2015 2/2 the same did not hit the informant. It is further alleged that petitioner snatched his silver chain weighing two bhari from his neck and threatened him to kill in case of lodging the case against them.

It has been submitted by the learned counsel for the petitioner that petitioner has no criminal antecedent and is innocent and has been falsely implicated in the present case. It has further been stated that allegation of assault against the petitioner, is not supported by the prosecution and also the injuries are not serious in nature.

Under such circumstances, let the petitioner namely Pramod Singh in the event of his arrest or surrender within a period of four weeks from today, before the learned court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town (Ratanpur) P.S. Case No. 690 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
