2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 325, 307, 302 of the Indian Penal Code.
3. As per the prosecution case, 16 FIR named accused persons including petitioner and 7 unknown persons armed with lathi, danda, assaulted the father of informant leading to his death.
4. It is submitted that allegation of assault is general and omnibus and no specific overt act has been alleged against this petitioner. Petitioner has been falsely implicated in this case due to old enmity. Similarly situated co-accused have been granted bail by a coordinate Bench of this court vide order dated
Patna High Court CR. MISC. No.42458 of 2023(2) dt.03-08-2023 2/2 24.02.2023 passed in Cr. Misc. No. 62638 of 2021 vide Annexure-2 to this petition. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Danapur, Patna in connection with Maner P.S. Case No. 443 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
