2. The petitioner seeks bail in connection with Belaganj P.S. Case No. 578 of 2023 registered for the offences under Sections 302, 201 and 34 of the IPC.
3. The petitioner is not named in the F.I.R. and is in custody since 02.02.2025.
4. The allegation against the petitioner is to involve in preparation of dacoity along with other named and unknown co-accused persons.
5. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired on
Patna High Court CR. MISC. No.40221 of 2025(2) dt.18-08-2025 2/3 the basis of confessional statement of Raju, in furtherance of which no incriminating material appears suggesting involvement of petitioner in the alleged preparation of dacoity. It is also submitted that similarly situated co-accused person namely Ajay Kumar has already granted bail by this Court through Cr. Misc. No. 25097 of 2025 dated 28.07.2025. While concluding the argument it is submitted that petitioner is a man of clean antecedent and moreover, investigation has already completed, and as such, there is no chance of tampering with the evidence.
6. Learned APP appearing on behalf of the State, opposes the prayer for bail.
7. In view of aforesaid facts and circumstances as mentioned above and by taking note of fact as save and except suspicion nothing transpires against this petitioner during the course of investigation, as to suggest his primafacie involvement in present preparation of dacoity, coupled with the fact as petitioner remains in custody since 02.02.2025, accordingly above named petitioner, is directed to be released on bail in connection with Belaganj P.S. Case
Patna High Court CR. MISC. No.40221 of 2025(2) dt.18-08-2025 3/3 No. 578 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
