Petitioner seeks bail in a case registered for the offences punishable under Sections 392/365 of the Indian Penal Code.

The petitioner who was driver of the truck of the informant was, alongwith the informant, going on the truck. Three motorcycle borne criminals looted away the truck. When the informant and this petitioner were chasing the truck, the petitioner could ride on the truck, hence he is also under suspicion that he was involved.

Submission is that in fact petitioner was also assaulted by the criminals while he was chasing and after committing assault against the petitioner, the petitioner was thrown down.

Patna High Court CR. MISC. No.38431 of 2020(2) dt.22-02-2021 2/2 Petitioner is in custody since 18.06.2020. Investigation of the case is already complete. Petitioner has got no criminal antecedent. Vehicle has also been recovered. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sahpur Police Station Case No.171 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
