2. The petitioner seeks regular bail in connection with Dhansoi P.S. Case No. 63 of 2024 registered for the offence under Sections 363, 366A, 34 of the Indian Penal Code and Section 8/12 of the POCSO Act.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the victim girl.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 13.05.2024. He next submitted that the victim in her statement recorded under Section 164 of the

Patna High Court CR. MISC. No.53522 of 2024(3) dt.25-09-2024 2/2 Cr.P.C. has not supported the prosecution case.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. From the statement of the victim girl recorded under Section 164 of the Cr.P.C., it appears that she had eloped with the petitioner on her own.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-VI-cum-Spl. Court, POCSO Act, Buxar/concerned Court below in connection with Dhansoi P.S. Case No. 63 of 2024.

9. This application stands allowed.
