JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 03-03-2017 The petitioner retired from the post of Junior Line Man from the office of Electric Supply Sub-Division, Samastipur (Sahari) on 31st January, 2013. He has filed the present writ application for

Patna High Court CWJC No.4663 of 2014 dt.03-03-2017 2/3 payment of retiral dues.

2. Despite repeated calls, no body appears on behalf of the petitioner to press the writ application.

3. A counter affidavit has been filed on behalf of the respondents wherein it has been mentioned that the North Bihar Power Distribution Company Limited has paid all the retiral dues of the petitioner. It is stated that the petitioner has been paid Rs.7,29,209/- vide cheque No.197848 dated 20.04.2014 under the head G.P.F., Rs.93,425/- vide cheque No.637880 dated 25.10.2013 under the head G.S.S., Rs.5,63,340/- vide cheque No.530583 dated 07.02.2015 under the head Gratuity, Rs.3,07,964/- vide cheque No.808918 dated 19.11.2014 under the head Leave Encashment and Rs.6,851/- vide cheque No.628356 dated 06.05.2015 under the head Interest on G.S.S.

4. Mr. Madan Prasad Jaiswal, learned counsel for the respondents submitted that now no retiral dues of the petitioner is pending before the respondents to be paid and probably for that reason the counsel for the petitioner is not interested in pressing the writ application.

5. Be that as it may, regard being had to the statements made in the counter affidavit and the submissions made by the
