02. 17.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 47(a) and 47(f) of the Bihar Excise Act.
It is contended on behalf of the petitioner that 20 Litres country-made liquor kept in one jerkin, one manufacturing machine and 150 Kg of Jawa Mahua kept in plastic container was destroyed by Excise Raiding Party. It is further contended that as per the prosecution report there is no recovery from the house of the petitioner. It is also contended that the petitioner is having clean antecedent.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.42831 of 2016 (2) dt.17-10-2016 case, the petitioner, namely, Ashok Choudhary @ Ashok Chourir is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Prosecution Case No. C 7-41 of 2012.
