====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 15-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Nardiganj P.S. Case No.72 of 2015 registered under Sections 341, 323, 307, 354(A), 379 and 504/34 of the Indian Penal Code. The accusation is that Anant Kumar alias Kundan Kumar, the nephew of the informant, Rakesh Kumar, started to abuse the wife of the informant. When the informant made protest then Anant Kumar alias Kundan Kumar and his brother, Alok Kumar alias Chandan Kumar, also abused and assaulted the informant causing head and hand injury to him. When the informant, his wife and two children entered to the house to save themselves then

No.43422 of 2015 (2) dt.15-10-2015 2/3 Anant Kumar alias Kundan Kumar and his brother, Alok Kumar alias Chandan Kumar and their father, Sohan Prasad and mother, Rekha Rani, armed with iron rod entered into the house of the informant and again started to assault the informant and his wife indiscriminately causing grievous injury to them. Learned counsel appearing on behalf of the petitioner submits that, in fact, hot exchange of words and scuffle took place in between Anant Kumar alias Kundan Kumar, the son of the petitioner, and the informant but with an ulterior motive, the informant has lodged this false case implicating the petitioner, her husband and son, Alok Kumar alias Chandan Kumar, also. It is also submitted that the occurrence took place due to grudge and dispute in between the children of the petitioner and the informant as the husband of the petitioner and the informant are own brothers.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K.L. Yadav, Judicial Magistrate, First Class, Nawada, in connection with Nardiganj P.S. Case No.72 of 2015, subject to the
