Petitioner seeks bail in Muffasil P.S. Case No.03 of 2019 instituted for the offence under Section(s) 302, 120-B Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that utmost it is a case of last seen.

In the written report, it is alleged husband of the informant had gone with this petitioner to take rupees forty thousand from Amarjeet Sahani. It is alleged that on 05.01.2019, husband of the informant received a call to meet Amarjeet Sahani on Bandh. It is further alleged that husband of the informant informed her that he is coming home with Ramesh.

There is no allegation of specific overt act against petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Samastipur, in connection with Muffasil P.S. Case No.03 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
