JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application for anticipatory bail for the offences under Sections 366A/34 and other sections of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and the victim girl in her statement before the Magistrate under section 164 of the Code of Criminal Procedure has stated that she is aged about 18 years and has gone with the petitioner on her own sweet-will. It has also been submitted on behalf of the petitioner that other accused persons have been granted anticipatory bail by this Court vide order dated 2.12.2016 passed in Cr.Misc. No. 51302 of

Heard learned APP appearing for the State who could not controvert this fact.

Having heard both sides and considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No. 208 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and further that the petitioner will cooperate with the investigation of the case.
