The petitioner seeks bail in Jogapatti P.S. Case No.202 of 2020 registered under Sections 328, 302, 498A and 34 of the Indian Penal Code.
The father of the deceased alleged that he got his daughter married fourteen years ago with Lalan Ram but the husband and other in-laws of his daughter were demanding additional dowry and torturing his daughter. On 25.05.2020, the informant after having received information of illness of his daughter, went to the house of his daughter and found his daughter lying unconscious. Froth was coming on her mouth. The informant alleged that his daughter was done to death after being assaulted by her husband and in-laws.
The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.37664 of 2020(2) dt.09-02-2021 2/2 petitioner is sister-in-law(gotni) of the deceased. The marriage of the deceased was solemnised fourteen years ago with Lalan Ram. Petitioner was living separately and she has got no manner of concern with family affairs of Lalan Ram and his wife. Petitioner is in jail since 19.08.2020.
Taking into consideration the facts that the deceased was married with Lalan Ram fourteen years ago and there is no report or complaint about the ill treatment at the hands of the petitioner during the subsistence of the deceased with her husband Lalan Ram and petitioner is sister-in-law of the deceased, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Jogapatti P.S.
