2. The petitioners have prayed for grant of bail in connection with Sursand P.S. Case No. 106 of 2024 registered under sections 420, 467, 471, 489-C, 489-D, 489E, 414 and 34

Patna High Court CR. MISC. No.45356 of 2024(8) dt.22-01-2025 2/3 of the Indian Penal Code.

3. The case of the prosecution is that the informant has made a team for checking the vehicles at that time, a bike was from the side of India was going towards Nepal. It was being intercepted and he described his name as Imteyaz Ansari who is aged about 22 years resident of Sitmarhi and from his possession fake currency of Rs. 11,200/- was recovered likewise from the possession of Md. Afzal Ansari Rs. 74,400/- of fake currency was recovered and from the possession of Adil Akhtar Rs. 19,000/- of fake currency was recovered.

4. Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They have falsely been implicated in this case. Learned counsel for the petitioner namely, Imtiyaz Ansari has submitted that he is a mechanic and he has received the said amount as his wages from his customers. Other petitioners' counsel has also stated that the petitioners, namely, Adil Akhtar and Md. Afzar Ansari are mechanic and they also received the said amount from their customers. They don't have any relation with the alleged fake currency. The status of the case was called from the trial Court and from perusal of the said report, it transpires that this case has been committed to the court of the session and trial has not

Patna High Court CR. MISC. No.45356 of 2024(8) dt.22-01-2025 3/3 yet started. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 29.02.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Sursand P.S. Case No. 106 of 2024 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi.
