JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-08-2019 Heard Mr. Sanjay Prasad, learned counsel for the petitioner, Mr. Binod Bihari Sinha, learned counsel for the Bank and Mr. Jharkhandi Upadhyay, learned counsel for the State.

The petitioner seeks quashing of the order dated 28.03.2017 passed by the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 207 of 2014 whereby cognizance has been taken under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code.

Mr. Sanjay Prasad, learned counsel for the petitioner, after some arguments, seeks permission to withdraw this petition in order to enable the petitioner to approach the court below for discharge.

No.43501 of 2019(2) dt.23-08-2019 2/2 Should such a petition of discharge be filed by the petitioner, the court below shall dispose it of by a reasoned order without being prejudiced by the fact that the present petition has not been entertained.
