JUSTICE RAKESH KUMAR ORAL ORDER 28-09-2016 Heard Sri Jai Prakash Verma, learned counsel for the petitioner and learned Additional Public Prosecutor This is second attempt for grant of bail on behalf of the petitioner in Sessions Trial No. 845 of 2014 arising out of Shiwaipatti P.S. Case No. 44 of 2014 registered for the offence under Section 3 / 4 of the Explosive Substance Act. Earlier prayer for bail of the petitioner was rejected on the ground of seriousness of accusation as well as the fact that petitioner was accused in one another case.
In this case by order dated 31.8.2016 a report was called for from the court below regarding the stage of the case which has been received and kept at flag "B". From perusal of the report dated 8th September 2016 it is evident that in trial out of
Patna High Court Cr.Misc. No.37717 of 2016 (3) dt.28-09-2016 2/2 nine witnesses five prosecution witnesses have already been examined. Meaning thereby that trial is continuing expeditiously. Accordingly, there is no reason to review my earlier order. Prayer for bail again stands rejected.
