29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Chapra Muffasil P.S. Case No. 165 of 2021, registered for the offence under Sections 413, 414/34 of the Indian Penal Code.

As per F.I.R., while the police party was on patrolling duty, they saw two miscreants, including this petitioner riding on a motorcycle, was coming, but after seeing the police party, they tried to flee away, however; on chase, they were apprehended and on search, one motorcycle and two master keys were recovered from their possession.

It is submitted on behalf of petitioner that no incriminating article has been recovered from conscious possession of the petitioner. The alleged motorcycle was recovered from the possession of co-accused Bittu Mishra. Petitioner is in custody since 11.04.2021. Investigation is complete.

Patna High Court CR. MISC. No.51399 of 2021(2) dt.29-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 165 of 2021.
