The petitioner seeks bail in Excise Case No. 274 of 2016, registered for the offences punishable under Sections 47 (a) (e) (g) and 54 of the Bihar Excise Amendment Act, 2016. The house of the petitioner was raided and from his house different articles prepared from Bhang were recovered. About 300 kgs. of Bhang and other articles were recovered from the house of the petitioner. The petitioner and his two sons were made accused. The sons of the petitioner namely Mithu Kumar and Aditya Kumar have already been enlarged on bail vide order passed in Cr. Misc. No. 48174 of 2016 on 20.12.2016. Considering the facts aforesaid and the fact that the petitioner is in jail since 16.09.2016 and similarly situated accused

Patna High Court Cr.Misc. No.48793 of 2016 (2) dt.09-01-2017 2/2 have already been enlarged on bail, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Excise Case No. 274 of 2016.
