JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 of the Indian Penal Code.
The accusation is of outraging the modesty of the complainant while she was being travelling in an auto rickshaw and snatching Rs. 300/-. It is also alleged that petitioner was earlier made accused for outraging the modesty of the daughter of the complainant. Hence petitioner was pressurizing the complainant to withdraw the case. It is submitted by learned counsel for the petitioner that for the occurrence of 10.06.2014 the complaint case filed on 12.06.2014 and due to the litigated relationship from before, the accusation has been levelled. Let learned Court below consider the prayer for regular bail of the petitioner, keeping in view the delayed
Patna High Court Cr.Misc. No.40148 of 2015 (2) dt.06-10-2015 2/2 lodging of the complaint and the stern relationship between the parties from before, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 1411 of 2014, pending in the Court of learned Chief Judicial Magistrate, Katihar.
With the observations above, the application stands disposed off.
