The application is for grant of bail for the offence under Sections 25 (1-b), a/26 of the Arms Act. It has been submitted on behalf of the petitioner that even from perusal of the First Information Report, it appears that petitioner has been named in the First Information Report on the basis of statement made by co-accused and nothing has been recovered from possession of the petitioner. It also appears from the seizure list prepared by the Police that there is no recovery from the petitioner. It has further been submitted that the petitioner is in custody since 08.08.2016.

Patna High Court Cr.Misc. No.54975 of 2016 (2) dt.22-12-2016 2/2 Having heard both sides, in view of the fact that nothing has been recovered from the possession of the petitioner and he is in custody for sufficient period, let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabhua in connection with Ramgarh P.S. Case No. 94 of 2016.
