The petitioner seeks bail in a case registered for offences under Section 30 (i) of the Bihar Prohibition and Excise Act.

It is contended that as per allegation, 35 litres of Nepali wine were recovered from the premises of Raghubansh Narayan Singh where the two wives of the petitioner were present who disclosed that their husband, i.e., the petitioner used to sell the liquor at the instance of the co-accused Raghubansh Narayan Singh and in absence of their husband they used to sell

It is further contended that co-accused persons namely Sayara Khatoon and Sabrun Khatoon who are the wives of the petitioner have already granted bail by a Co-ordinate Bench of this Court by order dated 12.05.2017 passed in Cr. Misc. No. 21846 of 2017. Petitioner claims that he is having clean antecedent and is in custody since 25.05.2017. Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, West Champaran at Bettiah in connection with Ramnagar P.S. Case No. 92 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
