The petitioner seeks bail in Rail Darbhanga P. S. Case No. 44 of 2018 instituted for the offence under Section(s) 379, and 411/34 Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He has been arrested merely on suspicion.

The informant got down from Bihar Sampark Kranti Train at platform no. 3 of Darbhanga Railway Station on 5.4. 2018 at about 2.30 PM. He met with a person there and became friendly and asked him to look to his bag and went to drink

Patna High Court Cr.Misc. No.41966 of 2018(3) dt.24-09-2018 2/2 water and after some time he returned back. The informant returned and found his belongings missing. It is further alleged that on the next date i.e. 6.4.2018 on platform no.1 in front of enquiry office the said man was seen with another man. The informant raised alarm and on chase he was apprehended and it is alleged that Rs. five thousand has been recovered from his possession. But no mobile was found.

In this manner, petitioner has been arrested merely on suspicion. Petitioner is in custody since 7.4.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM Railway, Samastipur in connection with Rail Darbhanga P. S. Case No. 44 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
