JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 120-B of the Indian Penal Code.

The present case was lodged on the basis of written report of petitioner but in course of investigation, it came to light that petitioner had love affair with one co-accused, Lalan Rai @ Lalan Kumar and she having entered into conspiracy along with aforesaid Lalan Rai @ Lalan Kumar got eliminated the deceased,

Patna High Court Cr.Misc. No.45641 of 2016 (3) dt.05-12-2016 2/2 who was her husband so that she could solemnize her marriage with co-accused, Lalan Rai @ Lalan Kumar. In course of investigation, the investigating officer collected call details and got recorded confessional statement of petitioner.

The investigation against the petitioner has already been completed and co-accused, Lalan Rai @ Lalan Kumar has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chiraiya P.S. Case No. 211 of 2015.
